Terms of Service
Last updated: July 2026
1. Acceptance of Terms
By accessing and using Swyft ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy and Refund Policy. If you do not agree, please do not use the Service.
2. Description of Service
Swyft is an event marketplace platform that connects event organizers with attendees. The Service includes event discovery, ticket purchasing, ticket management, guest lists, and social features. Swyft facilitates transactions but is not a party to the agreement between organizers and attendees.
3. User Accounts & Eligibility
You must create an account to purchase tickets or create events. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to use this Service. Certain events, including nightlife and age-restricted events, may require attendees to be 21 or older. It is the attendee's responsibility to verify age requirements before purchasing tickets. Swyft reserves the right to refuse service or terminate accounts for users who misrepresent their age.
4. Ticket Purchases
Tickets purchased through Swyft are subject to the specific event's terms and refund policy set by the organizer. Swyft charges a platform fee plus processing fees on each transaction. All fees are disclosed before purchase confirmation. By completing a purchase, you authorize Swyft to charge your payment method for the full amount displayed, including all applicable fees and taxes.
5. Refund Policy
Refund policies are determined by individual event organizers unless otherwise required by law. If an organizer offers refunds, they may be requested through your order history. Swyft facilitates refund processing through Stripe but does not guarantee refunds for events unless required by applicable law. For full details, please review our Refund Policy.
6. No Resale Above Face Value
Tickets purchased through Swyft may not be resold above their original face value. Swyft provides a ticket transfer feature that allows tickets to be gifted to other users at no additional cost. Any attempt to resell tickets for profit through external channels or by circumventing the platform's transfer system is prohibited and may result in account termination and ticket cancellation.
7. Organizer Responsibilities
Organizers are responsible for accurate event information, delivering the event as described, and handling attendee concerns. Organizers must connect a valid Stripe account to receive payouts and are responsible for their own tax obligations. Swyft reserves the right to remove events that violate these terms or that are misleading, fraudulent, or illegal.
8. Ticket Transfers
Tickets may be transferred or gifted to other users through the Swyft platform. Once transferred, the original ticket holder relinquishes all rights to the ticket. Transferred tickets remain subject to the event's terms and age restrictions. Swyft is not responsible for tickets transferred outside of the platform.
9. Prohibited Conduct
You agree not to: post false or misleading event information, sell counterfeit or duplicate tickets, use the Service for illegal activities, harass other users, attempt to disrupt the Service, scrape or reverse-engineer the platform, or use bots to purchase tickets. Violations may result in account termination, ticket cancellation, and legal action where appropriate.
10. Intellectual Property
Swyft and its original content, features, and functionality are owned by Swyft and protected by intellectual property laws. Event content belongs to the respective organizers. You may not reproduce, distribute, or create derivative works from content on the Service without permission.
11. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Swyft does not warrant that the Service will be uninterrupted, error-free, or secure, or that any event will occur as described. Event information is provided by organizers, and Swyft does not verify the accuracy or completeness of such information.
12. Limitation of Liability
To the fullest extent permitted by law, Swyft shall not be liable for: event cancellations, postponements, or changes by organizers; the quality, safety, or outcome of any event; actions or conduct of organizers, attendees, or other users; injuries, damages, or losses arising from attending an event; any indirect, incidental, special, consequential, or punitive damages; or any loss of profits or data. Swyft's total liability for any claim arising from the Service is limited to the fees paid by you to Swyft for the specific transaction giving rise to the claim. Swyft acts solely as a platform and is not the organizer, seller, or provider of any event.
13. Indemnification
You agree to indemnify and hold harmless Swyft and its affiliates, officers, employees, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: your use of the Service; your violation of these Terms; your violation of any rights of a third party, including organizers and attendees; or your organization or attendance of any event listed on the platform.
14. Force Majeure
Swyft shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, weather events, pandemics, government actions, labor disputes, internet or telecommunications failures, or power outages. Event cancellations or changes due to force majeure events are the responsibility of the organizer.
15. Third-Party Links & Services
The Service may contain links to third-party websites or integrate third-party services, including Stripe for payment processing. Swyft is not responsible for the content, policies, or practices of third-party sites or services. Your interactions with third parties are solely between you and the third party.
16. Privacy
Your use of the Service is also governed by our Privacy Policy. We collect and use your data to provide and improve the Service, process transactions, and send notifications including SMS and email where you have opted in.
17. Account Deletion
You may delete your account at any time through the Settings page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Tickets associated with active events may remain valid but will no longer be accessible through your account. Please transfer or save any tickets before deleting your account.
18. Dispute Resolution & Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be submitted to binding arbitration in Delaware. You waive any right to participate in a class action lawsuit or class-wide arbitration.
19. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or in-app notification. The date of last update will be reflected at the top of this page.
